that was killed is her brother. she said he had just come to the bay area and maybe only been here a week when he was shot. marin county sheriff's department is saying the shooting was phoned in a little bit after midnight. several residents reported hearing a number of shots fired and when they arrived, neighbors had actually tried to give this person cpr but it was too late. a friend of the sister believes this was gang related because there are gangs here in the area but the sister of this 17 year old believes that he stood out because he isn't from here. >> first christmas being with the family. first time being with the family. >> reporter: now the sister also told us that he just turned 17 years old maybe four or five days ago. she was very upset and trying to call their father in far northern california. at this point the marin county

sheriff's department does not have any suspect information. reporting live in marin county, christie smith, "today in the bay." new this morning, the uc berkeley student law student is pleading guilty for his involvement in a strange case in which an exotic bird was beheaded at a las vegas resort. 24-year-old pleaded guilty to a misdemeanor charge of instigating or engaging in animal cruelty yesterday. he was sentenced to 48 hours of community service and will have to pay about $350 in fines and restitution. fellow cal student faces felony charges for killing the bird. witnesses say the two men were seen carrying the bird's body and severed head at the

policem resort. prosecutors say a man took two kids from their mother's home in south san francisco back in september and then stole a yacht in alameda and sailed away. he says he was trying to save them from an abusive home. the children's mother recently sought a restraining order against him. if you have noticed a backup on the dumbarton bridge as you head to work, you are not alone. since the start of the year the commute from the fremont side to menlo park has been bad and there's a reason for it. they are closing one of the toll plazas. more coming up from bob redell in a live report. he's headed to the dumbarton bridge this morning on more on what's really being done to fix that problem to help your morning commute along. meanwhile, the mtc says the commute would be better if the state would give it more control. the examiner reports bay area closed circuit tv cameras, metering lights and electronic message signs on freeways are frequently broken or shut down. the tools are managed by caltrans and used by ymtc to

help manage local traffic congestion. mtc wants caltrans to give it more control system wide to fix the issue. time to check the forecast with meteorologist christina loren. it's cold out there. >> not a cold one you want to enjoy on a weekend. as we get into the weekend, it is going to be frigid. north bay, east bay and south bay, watch out for the possibility of some widespread frost as we progress throughout the morning hours temperatures will continue to drop off. if i taught you anything over the past couple of weeks, i hope it's that the fact is that coldest point of the day is right around sunrise. keep that in mind. so if you can, bring in sensitive plants. don't leave pets out for too long this morning. cold estrange 32 to 39 degreeses but because your windshield gets colder.

welcome back. a live look at what's under way in los angeles. right now police are outside the westchester mall where they think a woman is being held hostage. a pair of armed men entered the mall and think the men took a woman to the back of the store. we'll bring you the latest as soon as new developments unfold. 5:09. today is the day walmart starts that rather amazing deal on iphones. scott mcgrew is here to remind us of what that is. >> it was announced a couple days ago. today is the first day you can get the deal. walmart will sell you an iphone 5 no contract offering $45 a

month unlimited data talk and text. that alone is a great deal. this is all through walmart's straight talk service. now, make no mistake. buying an iphone 5 is not cheap. it will cost you at least $650. but the calculation is on this walmart deal, the overall savings will be about $1,000 a year. google managed to escape major fines and punishment over antitrust behavior earlier this month here in the united states with the ftc decided google's habits of changing search results to drive you to google's services didn't hurt consumers. this morning european regulators aren't going to roll over so easily and google will have to change its behavior overseas or face hefty fines. san francisco based wells fargo will report profits today. let's turn to courtney reagan live at cnbc world headquarters with a market preview. good morning, courtney. >> reporter: good morning to

elevation snow over the weekend. looks like sunday. i want to show you pictures from high atop mt. hamilton where we picked up good accumulations. this came in from one off our people here at nbc bay area. thanks for snapping the shots. very rare to get that snow in the bay area. for snow levels to fall to 2,500 feet was impressive. like i said before, we'll see another chance of that accumulating snow on sunday. really cool stuff there. temperatures are cold to start. freeze warning in place. prolonged temperatures below 30 degrees. we'll see probably three hours of temperatures right around freezing. frost advisory is in place for the south bay, east bay and the north bay interior valleys. a cold day ahead. 30 in gilroy. 35 in sunnyvale. 32 in oakland. jet stream is just to our south. it's not bringing in any rain. it's just pumping cold air into the bay area. it's going to be frigid for the next couple of days. 51 in san jose. 49 degrees for you in los gatos today.

getting into saturday, the clouds will increase. we'll start out nice and sunny and then as we get into sunday we get that chance for some low elevation snow. highs only in the upper 40s over the weekend inland. 5:14. a couple things out there so far this morning. what are you tracking? >> we were tracking a couple big accidents like you talked about. one of them a major injury accident in burkely. we'll talk about that in just a second. a smooth flow on the traffic lanes right here across the bay bridge coming down the commute direction for that westbound 80. smooth drive and it being friday we expect a lighter volume but still watch out for anything out there. live look outside farther south. this is oakland northbound here. taillights around high street and into downtown smooth flow steady volume. southbound side also moving very smoothly down toward that san mateo bridge. no delays past 238 or down toward 92. we'll give you the look there as well across the span. eastbound direction off the peninsula at 101, 280, easy and clear on the peninsula side. heading over there from the east

bay a smooth flow. no delays at the toll plaza. we have a smooth drive on the maps coming through the entire interchange there. we'll show you that map and we see 238 castro valley and 880 interchange. we do see slowing approaching the toll plaza as cars do slow down to make that approach. that's typical pattern as the volume just gets up to its normal pattern here on friday. we're looking to the tri-valley area as well. 680 earlier incident through san ramon and danville disabled vehicle that cleared from the southbound side. 580 westbound is the commute at speed for the most part and also a nice easy drive through pleasanton and sunol. northbound routes are your commute direction and those are moving smoothly. right there southbound 880 earlier accident that crash cleared but we do have a construction zone still blocking one lane. slowing on the approach. do that for condone any way. much farther south over the grapevi grapevine, closed because of snow overnight. if you are planning the trip,

check there. i'll post the link to the website where you can check the freeways as well. back to you. also new this morning, all lanes of eastbound 80 in berkeley are back open after a multicar crash happened near ashby avenue exit. a car spun out hitting the center divide and then look at the damage. broadsided by another car. two other cars were involved in that crash. the man driving the first car was taken to the hospital with major injuries. a sig-alert was issued for the area but it's been lifted. all lanes have reopened. a central california student is in critical can this morning after he was shot at a school by a fellow student. sheriff's deputies say a 16 year old armed with a shotgun walked on his high school campus yesterday and opened fire. it happened in taft. a small town just west of bakersfield. the teen was reportedly targeted two students who had bullied him for more than a year. the shooting continues to fuel

the contentious gun control debate. and this weekend that talk will get even hotter here in the bay area. once again the crossroads of the west gun show. it will be held saturday and sunday. in the past state lawmakers have tried to ban gun shows but the efforts have failed. 5:17. a public memorial will be held tomorrow for the petaluma teen whose body was found in a tahoe snow bank. the cause of alyssa byrne's death is pending. the 19 year old got lost on new year's eve in south lake tahoe. she was found dead four days later. tomorrow the memorial is at 10:00 a.m. inside the high school gym where she graduated. her family is asking people to wear pink. prosecutors say he stole

$160,000 in insurance premiums. he faces up to four years in prison. an elderly woman accused of stealing half a million dollars from a nonprofit organization she worked for. the santa clara county district attorney's office has charged the woman with grand theft. investigators say the 62 year old worked as a facilities administrator for the nonprofit company. the housing for independent people. they claim she generated work orders and had the company pay and pocketed that money. the nonprofit helps provide low-income housing for those with special needs. >> she's stealing from us and stealing from the people that are working hard three and four jobs to try to make it to support their family and have a place to live. >> bell has also been charged with a series of state tax violations. she'll be back in court on

monday facing nine years in prison if she is convicted. we have an update now on the situation that's happening outside a mall am downtown los angeles. we told you just a few minutes ago that a woman was being held hostage inside a nordstrom there where we got word that police have evacuated everybody but they did not catch the suspects. at this point we are waiting to hear description for these suspects but again a woman potentially being held hostage and that scene has now cleared. this is a live look outside the westchester mall in los angeles. we'll stay on this story to bring you the latest. there is still no word on who will be oakland's police department's compliance director. they failed to agree on who should fill that position by today's deadline. now both sides say they will submit separate recommendations of candidates to a federal judge today. whoever is chosen will oversee the department's implementation

of reforms mandated by decades old lawsuit settlements. a benefit concert is being held this weekend for injured giants fan brian stowe. the event features performances by current giants third base coach and his band. also on stage is the grateful dead's singer. the concert took place last january in napa but comcast, which owns this station, will broadcast the event on its comcast hometown network this sunday night at 8:00. >> all right. good music there for a good cause. big changes coming to a number of communities across the bay area. the commutes rather. hear about the changes that will go into effect for monday morning. here you go little man.

welcome back, everyone. what a beautiful picture out there looking toward san francisco this morning. you can see traffic picking up. maybe people getting a pickup on their weekend early. you made it to friday. 5:23. changes to its bus schedule. starting this weekend, times for nearly 40% of samtrans lines have been adjusted. they make tweaks to try to improve performing bus lines and stressing only the times have changed and no bus routes have been altered. you can find the new bus schedules at the website. heading out to sfo during the weekend, you should expect flight delays. starting tonight airport officials will shut down one of the runways. it's part of a federally mandated improvement project.

breaking news from marin this morning. the sister of a 17-year-old boy shot to death overnight says her brother had just moved to the bay area days ago. this morning he's dead. christie smith is live in marin. what are sheriff's deputies out there saying? >> reporter: at this point they are saying there were a lot of people who heard this happen but they're still looking for suspect information. they are asking for the public's help this morning. the 17 year old is her brother. i want to step aside so you can see what investigators are doing down the hill. that's why this young man was shot. the sister tells me there was a commotion outside of their home and the next thing she knew he had been shot. this was around 12:15 this morning on drake avenue. it started with several 911 calls. sheriff's deputies saying a number of people reported gunfire in the streets when deputies arrived they found a number of residents to help the victim.

deputies tried to perform cpr. it was too late. he was pronounced dead at the scene. the victim's sister said he recently moved here, just turned 17 about four days ago. >> i have seen him five minutes before this happened. he was coming to check up on me to make sure i was okay because there was stuff going on by my house. >> reporter: what kind of stuff? >> this guy was acting crazy like he was doing something around our house. i don't know what he was doing. my brother was freaked out by that. we g to be careful. >> reporter: now she thinks that her brother may have been targeted because he is not from the bay area. he's actually from weed, california, up near the border. another person who was with the sister believes that this may have been gang related but police aren't saying that. they're not sure. they are asking for the public's help if anyone saw anything to please give them a call. reporting live in marin city, christie smith, "today in the

bay." 5:32. san jose international airport williams a new flight today on one of the most advanced planes in the sky. they will land its first flight from tokyo in just a couple hours. >> this comes as the faa opens an investigation into the aircraft after a round of safety mishaps at other airports. scott mcgrew has been looking into the problems with the dreamliner. the airline says it's not concerned? >> it points out the particular aircraft on its way to san jose right now due in just after 9:00 a.m. has been in use for more than a year. there are concerns about the airworthiness of the boeing 787 in general nicknamed the dreamliner. the model was delayed for years at boeing factories. in the last week or so we've seen several problems with 787s at a variety of airlines with a cracked windshield, fuel leak in

boston and not the kind of publicity the airlines want. here's ana spokesperson last night. >> that is not our company. that's different airlines aircraft. we don't have any comment. >> in fact ana did have problems with 787 after that interview just hours ago including a cracked windshield in japan. now ana flight 1076 just north of hawaii right now due into san jose at 9:19. it will then turn around and head back to japan at 11:00 a.m. at 6:30 our time, transportation secretary ray lahood will have a press conference about the problems with the 787. we don't know what he's going to say. both airlines and boeing do say that airplane is safe. back to you. >> i was out there earlier this week and passengers we talked to we polled everybody and they say

nicely in your commute direction out of the north bay and again getting out of the area in the early afternoon you'll see slowing as folks head on interstate 80 toward sacramento. north bay live shot shows you san rafael easy flow of traffic bumping up a bit. no problems novato through san rafael. frosty windshield and maybe black ice but no reports for north bay and peninsula as we look at palo alto south of the dumbarton bridge a smooth flow here. i called on buddy bob redell who is out there. yesterday i got contacted by a mutual friend of ours, traffic tom, complaining about backups at the dumbarton. he's not the only one. you're out there. what's going on, bob? >> reporter: people who have been coming to dumbarton bridge noticed it this week. one of the toll lanes, we're talking about that one in the middle, toll lane number four has been shut down since the first of the year because of budgetary reasons. the bridge has not been able to staff it with a toll taker. as a result you have one less

lane and during the commute hours specifically between 7:00 and 9:00, you have seen a tremendous backup sometimes extending all of the way back to 880 and anyone who has gone on the dumb baarton bridge knows that's substantial. someone authorized to speak on behalf of the bay area toll authority said this week and through this morning's commute they've been out here evaluating the traffic situation and they do hope to have a plan, a remedy in place, perhaps as soon as monday. it would be one of two options. one, they find the money to man that toll lane number four so that toll booth is back open or two, it is fastrak capable so instead of making that closed, they could make it a fastrak only lane helping alleviate congestion. it won't be a cash lane but a fastrak only would be better than just a closed lane. reporting live at the dumbarton

vice president joe biden continues talks on gun control this morning. he says the administration is trying to consider all sides but the national rifle association does not agree. nra says the white house seems much less focused on helping kids and protecting them than it did on attacking the second amendment. that from the nra this morning nra's president said on the "today" show that he doesn't think congress can pass an assault weapons ban. that's not the only thing they're looking at here. vice president biden says his task force will be ready by tuesday to make recommendations to the president. much of what he's heard from various groups is week he says involve universal background checks. even at gun shows and possibly in private sales. as we await him putting together those recommendations for the president, we learned that gun sales are up across the country since the connecticut shooting and nra says they have 100,000 new members just in the last month. bringing video game industry into the talks is a new move. what kind of reaction are you hearing?

>> the nra blamed them from the start saying they are largely responsible violence in those games for the types of violence that we're seeing in aurora, colorado, and newtown, connecticut and other mass shootings. new jersey's governor chris christie saying we need to take a closer look and here on capitol hill there's a bill right now to put the money into that so another federal study aimed at whether or not violent video games contribute to actual violence. >> very good. thank you so much, tracie. an update on a developing story we've been following in los angeles this morning where s.w.a.t. teams rescued 14 employees at a nordstrom rack where they were held hostage for more than four hours overnight. police say they got a 911 call from an employee's boyfriend saying his girlfriend was trapped inside the store with two armed robbers. s.w.a.t. teams you can see there entered the store and found 14 employees that were hiding in bathrooms and locked storage

mystery this morning. madsen's friends say he may have gotten into a fight at the spot. a bar in downtown campbell, which is the last place madsen was seen. and then there's a 911 call campbell police say came from his own cell phone a short time before his death. >> to know that he had a 911 call and was from his cell phone him huffing and puffing like he's running from something. that's the only thing i can think of. it won't get out of my mind. >> he's a good kid. he was a good kid. he deserves more than that. he deserves to have justice. someone out run around that hit him and left him cold in the dirt. >> chp says it has specially trained investigators working the case and call it a top priority. one of the men that participated in that brutal gang rape of a teenager outside a homecoming dance in richmond in 2009 will be sentenced today.

morales faces up to 27 years in prison after pleading guilty in november. morales is one of a group of men accused of raping the 16 year old last october or thinge orte was sentenced. wrongful death suits have been filed against oikos school. the suits claim oikos should have known the shooter, one goh was a serious danger after disagreements he had with staff. police say goh has confessed to the murders. earlier this week he was found mentally incompetent to stand trial. there are new efforts to protect the personal data of clipper card users. metropolitan transportation commission will meet today to talk about reducing the amount of time it holds onto your personal data. last year the bay citizen reported a clipper card travel
